The Eye Neighbourhood Development Plan (NDP) is being prepared by the Town Council and local community and, when completed, will be used to help guide and shape future development in the parish.
On 13 January 2020, Mid Suffolk’s Cabinet committee agreed that, subject to implementing all of the modifications set out in the Independent Examiners Report, that the Eye NDP should proceed to a local referendum. That decision should have been confirmed through publication of a Decision Statement. We do that now to ensure, as per Government guidance, that the Eye NDP be given significant weight in decision making.
Both Town and District Council, with support from Locality, have been working together to prepare the referendum version of the Eye NDP. It was also intended that the referendum could take place on 7 May but the Coronavirus emergency and regulations linked to the Coronavirus Act 2020 meant that that was no longer possible. At present, no referendum can take place until May 2021 at the earliest, although Government also remain committed to keeping those regulations under review. We will do the same and will confirm the Referendum date as soon as we are able to do so. However, that delay does not prevent us from publishing the Referendum Version of this Plan so that it can be referred to in the meantime when determining relevant planning applications:
Mid Suffolk District Council appointed Rosemary Kidd, Dip TP MRTPI to carry out an independent examination of the Eye NDP. The examination has conducted through written correspondence. On 7 November the Examiner issued her final report which recommends that, subject to modification, the Eye NDP meets the basic conditions and that it should proceed to a local referendum.
A report on the above went to Mid Suffolk Cabinet on 13 Jan 2020. Planning guidance also provides advice on the weight to be attached to a post-examination Plan.
In accordance with Regulation 16 of the Neighbourhood Planning (General) Regulations, 2012 (as amended) the District Council undertook formal consultation on the content of the Eye NDP to see if it fulfils the Basic Conditions as required by Paragraph 8(1)(a)(2) of Schedule 4B of the Town and Country Planning Act 1990 (inserted by the Localism Act 2011). The consultation period ran from the 22 May to 5 July 2019.

A full assessment as to whether the Eye NDP fulfils the Basic Conditions will be undertaken by an Independent Examiner (see above). An initial check was, however, undertaken to confirm that the relevant requirements had been met at this stage. View the Regulation 15 Checklist
Respondents were also reminded that their comments would be forwarded to the independent examiner and, with the exception of personal contact details, would be published on this website.
The Pre-submission draft version of the NDP was assessed to determine whether a Strategic Environmental Assessment (SEA) and/or a Habitats Regulations Assessment (HRA) were required. The outcome was that the need for a SEA Scoping Report was 'screened-in, and the need for an HRA Scoping Report was 'screened-out'.
